Hey Phil, Longtime viewer of the show. Regarding your QOTD. I’m a 23 year old Interactive Analyst at an Advertising Agency and part of my job is managing the Facebook Campaigns for my clients. Advertisers always get this bad rep and I’m not so much a corporate tool bag since my office has less than 50 people and I wear jeans ever day (that’s gotta count for something, right?). Anywho, as an ‘evil Advertiser’ on facebook, it always scares me that the inclusion of more ads is going to drive away the users; selfishly by leaving me with a big chunk of my day free and my company might notice my usefulness dwindle. but in all fairness, People, for some reason, always feel quite entitled with Facebook and advertising, and I feel when it was about privacy, it was justified, but when you’re not paying for a service, and illegal shit isn’t being done, then just don’t use that service if you don’t like it. it’s that kneejerk reaction of the internet feeling like everything has to be free and not ad-supported, which is just unrealistic; since I know your relationship with advertising and youtube has led to business possibilities long before the flatbrim hat went out of style. I’d like to continue this conversation with you and the team at sourcefed about advertising; be it through a Q&A/AMA or contributing or whatever. Love the show!

I am a little torn. I feel like the indecency of that guy is absolutely disgusting. How could he steal all of his things and not at the very least move his leg off the track? But I don’t know if he should be held responsible for the guy who got so shit faced he passed out on train tracks… that guy was asking to get run over by a train. He committed a crime by being a theif, and is just a shitty person for not helping the guy… but I don’t think he should be held responsible for the stupid decision the drunk guy made… If the guy had a heart attack or something happened that wasn’t stupid as fuck then I feel like the theif guy should be charged with a higher crime… at the same time though how would he know if he was drunk or fainted or something… In my mind there is a lot of grey area.

Yes negligence should be a crime, but within reason.

If someone goes to rob someone when they could be helping said person, Negligence.

But if somone could help another person but doesn’t as the situation could be too dangerous I.e unstable building, live electricity etc. Then no, that can’t possibly be classed as negligence.

But this douchebag of the day, definatly a negligent asshole.

Hey Phil! You really read these? Anyway I’m personally not going to buy an Macbook no matter how good it is. Why? Because I can get better specs in a windows machine for less (at least with NZ pricing). Their prices are just too damn high for serious consideration at the moment.

The problem with making general negligence a crime is that a case could be made that this guy allowing himself to get so drunk that he stumbles and passes out on the tracks is negligence of self. So not only would this guy have lost his leg, but would be facing criminal charges as a result.

So you’d definitely have to make it an extension of a pre-existing crime, like you said when you proposed the hypothetical, “If the man died, would the guy be guilty of negligent homicide?” A question to which I would answer, “Yes.” So the crime would have to be “negligent whatever-the-crime-is-that-causes-someone-severe-and-potentially-lethal-harm.”

While I would have helped that man if I had been there, you can play the devil’s advocate by asking why a person should be held legally responsible for not correcting others’ mistakes? People can have a hard enough time looking out for themselves and those for which they are responsible without having to worry about helping every person in need in fear of legal reprimands.

That, and the people that DO help these kinds of people would no longer be BAMFs. They’re no longer going above and beyond the call of duty. They’d just be your run-of-the-mill law abiding citizen.

Here is the unfortunate thing… in the States (and also Canada) if you attempt to help someone, and for whatever reason your helping them causes some sort of harm to them… they pretty much have to sue you. I mean, that’s a dick move if the “harm” is tearing their hoodie hauling their drunk ass off the tracks, but let’s say you accidentally kinda-sorta bend their spine. That’s a big deal, it’s your fault, and the only way they can protect themselves financially is to sue you. Would I personally have helped the guy anyways? Yes. Should you? Think twice in the United Sue-Peoples of America.

Btw, if he’d died, yes, that should be negligent manslaughter, because he’s not actively killing someone, but he’s going out of his way to do nothing at all about his staying alive.

I’ll admit, I would love to see some kind of punishment for negligence. We could call it ‘Doucebag’ Tax. However, the lines and circumstances would have to be so vague that it would mean people could claim negligence instead of facing up to the actual severity of their crimes. Great idea, but it would be too hard to implement.

Philip fuckin’ Defranco! ( I may have mistaken your middle name). Anyways, dude, you are an inspiration to me. If it weren’t for you I wouldn’t be as politically educated as I am today. Last week there was a mock debate/election at my school. I solely represented Gary Johnson and I used Sourcefed’s Gary Johnson video as my opening statement. I ended up with 16 percent of the votes from my school! It was awesome. And all thanks to you and sourcefed. I’ve been watching your show since I was in 7th grade (I’m a senior now). You’ve given me a lot of knowledge and provided my days with humor when I really needed it. I am currently in college, was majoring in math but am either going to change it to political science or electronic media and film. During the Apple Event, the people clapping they kept showing in the audience (and when Tim Cook announced sales) were actually Apple employees, I saw Scott Forestall, Jonathan Ive and a few other execs who’s names I can’t remember in that bunch, so of course they’re clapping, because they’d like to keep their jobs, also because more padding for their wallets!

I am quite enjoying this new feature! This whole site actually! I do wish there was a latest posts first section (kind of like twitter so i didn’t have to wade through old posts I have read before to get to what’s new)! But I don’t know what to think about this question, I don’t think that people should be judged by other people moral compass, for example if the guy on the train track was a known mass murderer would it be okay to leave him there then because you knew you would not get punished
